By accessing or using FotoViva AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms constitute a legally binding agreement between you and FotoViva AI.

FotoViva AI provides AI-powered photo restoration, colorization, repair, and enhancement tools. The Service is provided on an "as is" and "as available" basis. We continuously improve our AI models, but results may vary depending on image quality, damage severity, and other factors.

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information during registration.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized access to your account.
• Be solely responsible for all activity that occurs under your account.

You may not use the Service to:

• Upload or process images that infringe on third-party intellectual property rights.
• Upload illegal, harmful, threatening, abusive, or obscene content.
• Circumvent usage limits, access controls, or security measures.
• Reverse engineer, decompile, or attempt to extract the source code of our AI models.
• Use automated scripts, bots, or scrapers to access the Service.
• Resell, redistribute, or white-label the Service without written permission.

We reserve the right to suspend or terminate accounts that violate these rules.

You retain full ownership of all photos you upload. We claim no ownership rights over your images. By uploading photos, you grant us a limited license to process them solely for the purpose of providing the Service you requested. This license terminates when you delete the photo or your account.

We want you to be satisfied with FotoViva AI:

• Pro plan refunds: If you are unsatisfied with the Service, you may request a full refund within 14 days of your initial purchase, provided you have processed fewer than 10 photos.
• Credit refunds: One-time credit purchases are non-refundable once credits have been used.
• Technical failures: If a processing job fails due to a technical error on our side, we will restore the credit to your account at no charge.
• To request a refund, contact support@fotoviva.ai within the applicable window.

FotoViva AI, our logos, trademarks, software, and AI models are the intellectual property of FotoViva AI and its licensors. You may not use our trademarks or branding without prior written consent.

THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESTORATION RESULTS WILL MEET YOUR EXPECTATIONS. AI-generated results are probabilistic and depend on input quality.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOTOVIVA AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless FotoViva AI and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

We may suspend or terminate your account at any time for violations of these Terms. You may also delete your account at any time from your Dashboard. Upon termination, your right to use the Service ceases immediately, and we will delete your data in accordance with our Data Deletion Policy.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance of the revised Terms.
